1. Who We Are
This website ("Site") is operated by GM Instruments Pty Ltd (ABN 13 079 692 970), referred to as "we", "us" or "our" throughout these Terms of Service.

2. Acceptance of Terms
By accessing and using this Site, including placing any order, you agree to be bound by these Terms of Service.

3. Changes to Terms
We may revise these Terms at any time. Please check back before placing each order to review the current terms.

4. Ordering Products
Orders are submitted via this Site. Each order is an offer to purchase the selected products for the stated price. We may request further details to process your order. By ordering, you consent to receiving follow-up emails about your experience (opt-out available).

5. Acceptance & Rejection
We reserve the right to accept or reject any order due to issues like pricing errors, stock availability, or suspected fraud. If rejected, we will notify you in a timely manner.

6. Accuracy of Information
While we aim for accuracy, product details, pricing, and availability may change. Descriptions are summaries and subject to updates or correction. If a product is misrepresented, your remedy is a return for refund in unused condition.

7. Delivery
Delivery fees apply. Estimated timeframes are provided, but delays may occur. We are not liable for late deliveries. Risk transfers to you upon delivery. Delivery partners may offer tracking or delivery options via email/SMS. Orders are shipped within Australia and International.

8. Cancelling Orders
Orders can be cancelled before dispatch by contacting us. Once dispatched, cancellation is not possible. Custom or made-to-order products cannot be cancelled.

9. Returns
Please see our Returns Policy for full details. Products with defects must be reported promptly, with images if requested. Change-of-mind returns for custom or special-order items are at our discretion and may incur a fee.

10. Warranty & Liability
Our products come with guarantees under Australian Consumer Law. You are entitled to a refund or replacement for major faults. We make no warranties beyond those required by law and are not liable for indirect or consequential losses.

11. Your Responsibilities
You agree to:

  • Maintain secure access to your account
  • Notify us of any account breaches or changes
  • Comply with relevant laws

12. Severability
If any part of these Terms is found unlawful or unenforceable, the remaining terms will continue in full force.

14. EU Sales & Compliance

If you are a customer located within the European Union (EU), the following additional terms apply to your purchase:

1. Delivery & Risk

  • We agree to deliver goods within 30 calendar days from the date of the contract, unless both parties explicitly agree otherwise.
  • Risk in the goods passes to you once they are delivered to your address.
  • We are responsible for any loss or defect in the goods up to the point of delivery (unless caused by your actions).

2. Withdrawal / Cancellation Right

  • Under EU law, you have a 14-day right of withdrawal from the date you (or your nominated third party) receive the goods.
  • This right applies even if the goods are dispatched before the end of that period.
  • To exercise the right, send us notice via email at orders@gminstruments.com.au before the 14-day period ends, then return goods in original condition.
  • You bear the cost of return shipping unless the goods are defective or incorrect.
  • We will refund all payments including original delivery costs within 14 days of receiving the returned goods.

3. Conformity & Warranty

  • You have a two-year legal guarantee (warranty of conformity).
  • If goods are defective or do not match the contract, you may request repair or replacement. If that is not possible or would be disproportionately costly, you may request a price reduction or full refund.
  • You must report defects to us promptly, within a reasonable time after discovering them.

4. Governing Law & Jurisdiction

  • These terms are subject to your national consumer protection laws (in your EU Member State).
  • In case of dispute, you may bring proceedings in the courts of your Member State of residence, or the courts of Australia if you prefer.
  • We will not require you to waive or limit your mandatory rights under EU consumer protection law.

5. Dispute Resolution

  • You are entitled to use the EU Online Dispute Resolution (ODR) platform via: https://ec.europa.eu/consumers/odr
  • We will also attempt to resolve complaints via our internal customer service process.

6. Prohibitions on Unfair Terms

  • Nothing in these terms may exclude or restrict your rights under applicable law (e.g. EU Unfair Contract Terms Directive).
  • In case any clause is found unfair or unenforceable under EU law, it will be severed while the rest remains in force.

17. Gift Cards
